These Terms of Service (“Terms”) govern your use of rockyandmaggies.com and any products or services offered by Rocky & Maggie’s (“Rocky & Maggie’s,” “we,” “us,” or “our”).
By visiting our website, creating an account, placing an order, or otherwise using our services, you agree to these Terms and any policies referenced within them, including our Privacy Policy, Shipping Policy, and Return & Refund Policy.
Our online store is hosted by Shopify Inc., which provides the ecommerce platform through which we offer our products and services.
1. Eligibility & Acceptable Use
You must be the age of majority in your jurisdiction or have the permission of a parent or legal guardian to use our website or make purchases.
You may not use our website, products, or services for any unlawful, fraudulent, abusive, or unauthorized purpose or attempt to interfere with the operation or security of our website.
We reserve the right to restrict or terminate access to our services when these Terms are violated.
2. Products & Availability
Rocky & Maggie’s operates primarily as an online retailer. Products may be stocked or fulfilled by us, manufacturers, distributors, dropshipping partners, or other authorized fulfillment providers.
Product availability is not guaranteed. We may modify, discontinue, substitute, or limit the availability of products at any time without notice.
We make reasonable efforts to accurately display product descriptions, photographs, colors, dimensions, specifications, pricing, and other information. However, actual products may vary slightly from images or descriptions, including because of manufacturer changes, packaging updates, screen settings, or other factors outside our control.
We reserve the right to limit quantities or restrict sales of any product.
3. Orders & Order Acceptance
Submitting an order does not necessarily constitute our acceptance of that order. We reserve the right to accept, reject, limit, or cancel an order for reasons including:

- Pricing or description errors
- Suspected fraud or unauthorized transactions
- Payment authorization problems
- Shipping or fulfillment limitations
- Unusually large quantities
- Suspected resale or commercial redistribution

If we cancel an order after payment has been processed, we will issue an appropriate refund to the original payment method. Order confirmation emails acknowledge that we received your order and do not necessarily constitute final acceptance or guarantee fulfillment.
4. Pricing & Payment
Prices are displayed in U.S. dollars unless otherwise stated and may change without notice.
We make reasonable efforts to ensure pricing and promotional information is accurate. If a product is listed at an incorrect price because of a typographical, technical, supplier, or other error, we reserve the right to correct the error and cancel affected orders, including after an order has been submitted.
Applicable taxes, shipping charges, surcharges, or other costs will be displayed during checkout when required. You agree to provide current, complete, and accurate billing, payment, shipping, and account information.
5. Shipping & Fulfillment
Shipping and delivery are governed by our Shipping Policy.
Orders may ship from different locations and may arrive in multiple packages. Some products may be fulfilled directly by manufacturers, distributors, warehouses, or other fulfillment partners.
Processing, shipping, and delivery dates are estimates unless expressly guaranteed. Delays may occur because of carriers, weather, inventory availability, suppliers, holidays, address issues, or other circumstances outside our reasonable control.
Customers are responsible for providing a complete and accurate delivery address. Additional charges resulting from an incorrect or incomplete address may be the customer's responsibility where permitted by law.
6. Returns, Refunds & Exchanges
Returns, refunds, and exchanges are governed by our Return & Refund Policy.
Do not return merchandise without first obtaining return authorization and shipping instructions. Because products may be fulfilled from different locations, the appropriate return address may differ from the address shown on your original shipment or our corporate mailing address. Unauthorized returns or merchandise sent to an incorrect location may not qualify for a refund.
7. Promotions, Discounts & Gift Cards
Promotional offers, discount codes, free-shipping offers, credits, and similar incentives may be subject to additional terms, including expiration dates, minimum purchase requirements, product exclusions, or usage limits.
Unless otherwise stated:
- Promotions cannot be combined.
- Discounts have no cash value.
- Discounts cannot be applied retroactively to completed purchases.
- Promotions may be modified or discontinued at any time.
Orders involving misuse, duplication, manipulation, or unauthorized distribution of promotional offers may be canceled. Gift cards and store credits are subject to applicable law and any additional terms presented when issued.
8. Subscriptions & Recurring Purchases
Certain products may be offered through subscription or recurring-purchase programs. If you enroll in a subscription, you authorize recurring charges to your selected payment method according to the frequency and pricing disclosed when you enroll.
Subscription pricing, discounts, shipping charges, and product availability may change as permitted by the terms presented with the subscription and applicable law.
You may manage or cancel eligible subscriptions through the account or subscription-management options provided on our website, subject to any terms disclosed at enrollment. Cancellation of a subscription does not automatically cancel an order that has already been processed or shipped.

Fraudulent purchases, payment disputes, return fraud, product substitution, promotional abuse, or other intentional misuse of our services may result in account restrictions, cancellation of orders, denial of refunds where permitted, recovery of losses, or referral to appropriate authorities.
